Terms of Service

By accessing or using any app or service operated by Nicomedia Labs LLC (“Nicomedia Labs,” “we,” “us,” or “our”), including DoSomething (dosomething.nicomedialabs.com), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our services.

We may update these Terms at any time. We will indicate the effective date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

You must be at least 13 years of age to use our apps and services. By using our services, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the services.

Our apps are provided for personal, non-commercial use. You agree to use our services only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the services in any way that violates applicable law or regulation.
• Attempt to reverse-engineer, disassemble, or otherwise tamper with our software or infrastructure.
• Use automated tools (bots, scrapers, etc.) to access our services in an excessive or abusive manner.
• Circumvent any rate limits, security measures, or access controls.
• Interfere with or disrupt the integrity or performance of our services.
• Use our services to transmit any harmful, offensive, or unlawful content.

We reserve the right to suspend or terminate access to our services at any time, for any reason, including violations of these Terms.

Some features of our apps allow you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information when creating an account and to promptly update it if anything changes. You may not create an account on behalf of another person without their express permission.

DoSomething suggests nearby places of interest based on data from third-party sources, including the Google Places API. These suggestions are provided for informational and entertainment purposes only.

Nicomedia Labs does not own, operate, endorse, or have any affiliation with any place suggested by our apps. We are not responsible for:

• The accuracy or completeness of place data, hours, or ratings.
• Any experience you have at a suggested location.
• Any loss, damage, or injury arising from visiting a suggested place.
• Places that are closed, inaccurate, or unavailable when you arrive.

Always verify hours and availability before visiting. Exercise your own judgment when visiting any location.

All content, code, design, trademarks, logos, and materials associated with Nicomedia Labs and its apps — including DoSomething — are the property of Nicomedia Labs LLC or our licensors, and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use our apps for personal, non-commercial purposes. This license does not include any right to copy, modify, distribute, sell, or sublicense any part of our services.

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NICOMEDIA LABS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content or suggestions provided through our services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICOMEDIA LABS LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS GREATER.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in California for the resolution of any disputes arising under these Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
